About the Podcast

8th Amendment Café is a space to talk honestly about the U.S. criminal justice system—its cracks, its complexities, and its consequences.

Named after the 8th Amendment to the Constitution—our protection against excessive bail, fines, and cruel and unusual punishment—this podcast explores how far we've strayed from those ideals, and what it means for people caught in the system.

Each week, host Kevin Kerr brings you stories, analysis, and interviews with public defenders, formerly incarcerated people, legal scholars, and activists. Whether it’s plea bargains, mass incarceration, prison conditions, or bail reform, this show asks:  what does justice really look like in America?
